Scorepad Terms of Service
These Terms of Service (“Terms”) constitute a legally binding agreement between Koll Corp Services Pvt. Ltd. (“Scorepad,” “Company,” “Koll Corp,” “we,” “us,” or “our”) and the individuals or legal entities accessing or using our mobile applications (iOS/Android) and web portals (collectively, the “Platform”).
By creating an account, clicking “I Agree,” or otherwise using the Platform, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Platform.
1. Multi-Sided Platform Structure & Roles
Scorepad operates an intermediary platform connecting four distinct stakeholder groups:
- Players (Mobile App): Individuals who browse tournaments, register, pay entry fees, record scores, and purchase equipment or event gear.
- Tournament Organizers (Web Portal & Mobile App): Individuals, clubs, or entities creating tournaments, establishing competition rules and formats, collecting entry fees, purchasing bulk event merchandise/goodies, and soliciting corporate sponsorships.
- Merchants / Equipment Vendors (Web Portal): Third-party commercial sellers offering golf equipment, apparel, trophies, and tournament goodies via the integrated marketplace for fulfillment to players or organizers.
- Sponsors / Brands (Web Portal): Corporate partners and advertisers identifying tournaments to sponsor based on aggregated participant demographics and reviewing proof of sponsorship deliverables submitted by organizers.
Scorepad acts solely as a technology provider and marketplace facilitator. Except where explicitly stated, Scorepad is not a golf course operator, tournament committee, retail merchant, insurer, or sponsorship broker.
2. Account Registration, KYC, and Security
- Eligibility: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an Organizer, Merchant, or Sponsor account. Players between 13 and 18 must have parental or legal guardian consent to register.
- Account Integrity: You agree to provide accurate, current, and complete registration information and maintain its accuracy.
- Identity Verification & Anti-Money Laundering (AML/KYC): Organizers and Merchants receiving financial payouts through the Platform must complete identity verification and Know-Your-Customer (KYC) screening required by our integrated Payment Service Providers (PSPs). Failure to supply required legal entity documentation, tax identifiers, or banking details will result in suspension or withholding of disbursement payouts.
- Credential Security: You are responsible for safeguarding your login credentials. You must notify Scorepad immediately of any unauthorized access to your account.
3. Financial Terms, Payment Gateways & Escrow Rules
3.1 Payment Processing Services
Payment processing on Scorepad is provided by third-party Payment Service Providers (including, but not limited to, Stripe, Razorpay, or banking acquirers).
By transacting on the Platform, you agree to be bound by the applicable PSP agreements (e.g., the Stripe Connected Account Agreement or regional equivalents). Scorepad does not store raw credit/debit card numbers on its servers.
3.2 Platform Fees and Deductions
Scorepad may deduct a technology convenience fee, platform commission, or marketplace service fee from tournament registrations, marketplace transactions, or sponsorship payouts before remitting net proceeds to Organizers or Merchants. All applicable platform fees are disclosed prior to checkout or settlement.
3.3 Connected Accounts, Payouts, and Reserves
- Tournament Registration Payouts: Entry fees collected via Scorepad are credited to the Organizer’s connected PSP account subject to a rolling settlement schedule. Scorepad reserves the right to withhold or delay disbursements until after the successful completion of the scheduled tournament date to safeguard against cancellations or non-performance.
- Marketplace Vendor Payouts: Net funds from goods sold via the marketplace are remitted to Merchants upon valid proof of dispatch/carrier tracking or confirmed delivery.
- Rolling Reserves: To mitigate risk from chargebacks, refunds, or fraud, Scorepad and its PSPs reserve the right to establish a rolling reserve on an Organizer’s or Merchant’s account balance.
3.4 Chargebacks, Disputes, and Negative Balances
- Organizer & Merchant Liability: If a player or buyer initiates a payment dispute, credit card chargeback, or statutory refund claim regarding an event or purchase, the respective Organizer or Merchant is solely responsible for the disputed amount, associated bank chargeback fees, and currency conversion losses.
- Setoff Rights: Scorepad and its PSPs are authorized to debit the connected bank account of the Organizer or Merchant, withhold future settlement transfers, or offset against other balances to satisfy any negative balance or indemnity claim.
4. Tournament Organizers: Rules and Obligations
- Event Management: Organizers hold complete operational and legal responsibility for their tournaments, including venue contracts, player safety, compliance with local health regulations, format rules (e.g., Stroke Play, Match Play, Scramble, Stableford), and prize distribution.
- Cancellations & Inclement Weather: Organizers must establish clear cancellation, refund, and rainout policies and post them conspicuously within the tournament setup. If an event is canceled without being rescheduled, the Organizer must promptly authorize full refunds of entry fees minus unrecoverable payment gateway transaction costs.
- Prize Indemnity / Hole-in-One Contests: If offering high-value prizes (e.g., luxury vehicles, large cash sums) for hole-in-one or skill contests, Organizers must independently secure required prize indemnity insurance policies. Scorepad bears no responsibility for fulfilling tournament prizes or adjudicating side competitions.
- Ruling and Appeals: Any on-course disputes, requests for rulings under the Rules of Golf, or handicap protests remain under the jurisdiction of the Organizer’s designated Tournament Committee, not Scorepad.
5. Players: Registrations, Scoring & Conduct
- Tournament Participation: Players register for tournaments voluntarily and assume all inherent physical risks associated with playing golf (including lightning strikes, errant golf balls, cart incidents, or bodily injuries). Players release Scorepad and its affiliates from any liability for personal injury or property damage sustained at an event.
- Honesty and Score Submission: Players agree to record accurate hole-by-hole scores and refrain from handicap manipulation (“sandbagging”), scorecard alteration, or collusion. Scorepad reserves the right to disqualify or ban any user proven to have submitted fraudulent scoring data.
- Refunds: Registration cancellations and refund eligibility are governed solely by the hosting Organizer’s published tournament policy. Scorepad cannot unilaterally override an Organizer’s non-refundable event policy unless the tournament itself was fraudulent.
6. Marketplace: Merchants and Drop-Shipping Terms
- Merchant as Seller of Record: Merchants who list products on the Platform are independent commercial sellers and the legal sellers of record. Scorepad acts exclusively as a marketplace venue connecting buyers and sellers.
- Product Compliance: Merchants warrant that all listed golf equipment, apparel, and custom tournament goodies comply with consumer safety standards, are genuine (non-counterfeit), and do not infringe any third-party intellectual property or trademark rights.
- Fulfillment and Drop-Shipping: Merchants must fulfill, pack, and ship orders within their stated handling timelines, providing legitimate carrier tracking numbers through the Platform.
- Returns, Defective Goods, and Warranties: Merchants must publish a return and warranty policy compliant with applicable consumer protection legislation. In the event of damaged or defective goods, the Merchant must replace the item or refund the purchase price.
7. Sponsorship Marketplace: Deliverables and Proof
- Demographic Matching: Scorepad may provide Brands with aggregated, non-personally identifiable demographic statistics (e.g., participant handicap ranges, age distribution, geographic reach) to assist in tournament selection. Scorepad does not guarantee any specific commercial return on investment (ROI) or player conversion rate.
- Contractual Relationship: Sponsorship agreements facilitated through Scorepad are direct commercial contracts between the Sponsor and the Organizer.
- Proof of Deliverables: Organizers must upload photographic, verifiable evidence (e.g., geo-tagged photos of on-course signage, hole-in-one car placement, apparel branding, or stage banners) via the app to substantiate that the agreed-upon sponsorship deliverables were fulfilled.
- Sponsorship Disbursements & Escrow: Sponsor funds may be held by Scorepad or its PSP until the Organizer uploads satisfactory proof of execution. If an Organizer fails to host the event or supply the promised marketing deliverables, funds will be returned to the Sponsor in accordance with the sponsorship package agreement.
8. Intellectual Property & User Content
- Platform Ownership: All proprietary code, algorithms, user interfaces, branding, and tournament scoring engines powering Scorepad are the exclusive intellectual property of Scorepad Technologies, Inc.
- User-Generated Content License: By uploading tournament logos, photos of signage, scorecards, product listings, or sponsor media, you grant Scorepad a non-exclusive, worldwide, royalty-free license to host, display, and process such assets for Platform functionality, marketing case studies, and verification purposes.
- Trademark Protection: Tournament Organizers and Merchants agree not to use protected trademarks (including “USGA,” “GHIN,” “R&A,” or golf equipment brand logos) without explicit licensing authorization from the respective trademark owners.
9. Prohibited Conduct
You agree not to:
- Use the Platform for unlawful gambling, unauthorized betting pools, money laundering, or illegal raffles.
- Interfere with, reverse-engineer, decompile, or tamper with the live leaderboard, scoring engine, or platform security.
- Scrape, spider, or harvest personal data of players, organizers, or sponsors for unauthorized external marketing or data brokering.
- Submit fabricated or artificially staged proof-of-performance photos for sponsorship campaigns.

- Informal Negotiation: Before filing any formal claim, the parties agree to attempt to resolve any dispute informally for at least thirty (30) days by contacting [email protected].
- Binding Arbitration & Class Action Waiver: Any unresolved dispute, controversy, or claim arising out of or relating to these Terms shall be settled by binding individual arbitration administered by a recognized arbitration association. To the fullest extent permitted by law, you agree to waive any right to bring or participate in a class-action, collective, or representative proceeding against Scorepad.
12. Modifications and Termination
Scorepad reserves the right to update or modify these Terms at any time. When material updates are made, we will update the “Last Updated” date and provide notice via the Platform or registered email address. Your continued use of the mobile app or web platform following the posting of revised Terms constitutes your binding acceptance of the changes.
We reserve the right to suspend or terminate any user account (Player, Organizer, Merchant, or Sponsor) at our sole discretion, without prior notice, for conduct violating these Terms, jeopardizing tournament integrity, or creating financial liability.
